Is there a defined meaning to "pending?" I.e., does it mean the number of days since the request for hearing has been filed or is it, since "pending decision writing" status was applied.
ReplyDeleteI assume it is the latter, given if multiple AC remands are involved, it would not be that unlikely for a 1000+ days since the initial request for hearing was filed...then again, that makes it all the more disturbing that the extremely aged cases literally would just be awaiting their hearing.
I think it's from when the hearing request was made OR when the case got back to the hearing office after a remand. So a case where the hearing request was made on 1/1/16 counts as 365 days if it was denied on 1/1/17. Then if it goes to the AC and federal court and is remanded and gets back to the HO on 3/1/19 it's been pending 19 days as of 3/20/19.
