I have received the first report of a case remanded by Social Security's Appeals Council on account of the Supreme Court decision in Lucia v. SEC. It was sent back to a different Administrative Law Judge.
I saw that one of your federal district court cases was remanded even without an objection before the ALJ or AC. Congrats Charles, shouldn't all those FF cases be re-heard as well if not signed by a properly appointed ALJ?
@5:13pm - that's the stinger, isn't it? Decisions made by a non-appointed ALJ are improperly issued even if they are favorable... That's lots of attorneys fees to return pending a proper decision...
Was it addressed in the remand, or did SSA just find some other issue they'd rather deal with on remand?
