ALJ Training Notebook

     As part of its long list of proactive disclosures, Social Security has released its 2019_ALJ Training Materials It's more than 1,000 pages long. The vast majority of it, if not all of it, is material that was already available to the public. Someone with more time on their hands than me may be able to comb through it and find new material. It may be a useful desk book for attorneys representing claimants since it contains most of the policies that Administrative Law Judges are supposed to follow.

  1. Hard to believe there is such a thing since no one seems to hold ALJ's accountable for their not so stellar work or work ethic. But, with all the changes going on at the AC, perhaps the ALJ program at hearing offices will not be around much longer.

  5. 7:40 AM. Nice try, but the AC is under historic backlogs while the ALJs eliminated theirs. The AC had to bring on ODAR attorneys on detail to reduce their backlog. So where, exactly, is the work ethic problem at the ALJ level?

    1. AC backlog-poor to no ALJ understandIng of the law, poor ALJ instructions and poorly drafted decisions. Why? Poor management and poor time management because of the unconscionable production demands place on staff. There you go OHO, yet another mess on your hands. Good job!

    2. 1:20, ALJ training has been eliminated as of 3-4 years ago. ALJs used to get triennial training but that was cut. That was the AC's call, I think. ALJ instructions are now drafted by a tool created by the AC, but ALJs no longer have oversight over the staff writers, so decision quality is poorer even while the instructions are computer guided for policy compliance.
