A Salute To Those Who Resist Weaponizing The Death Master File

      From the Washington Post:

Two days after the Social Security Administration purposely and falsely labeled 6,100 living immigrants as dead, security guards arrived at the office of a well-regarded senior executive in the agency’s Woodlawn, Maryland, headquarters.
Greg Pearre, who oversaw a staff of hundreds of technology experts, had pushed back on the Trump administration’s plan to move the migrants’ names into a Social Security death database, eliminating their ability to legally earn wages and, officials hoped, spurring them to leave the country. In particular, Pearre had clashed with Scott Coulter, the new chief information officer installed by Elon Musk. Pearre told Coulter that the plan was illegal, cruel and risked declaring the wrong people dead, according to three people familiar with the events.
But his objections did not go over well with Trump political appointees. And so on Thursday, the security guards in Pearre’s office told him it was time to leave. …

Staffers at Social Security began raising the alarm about the urgent need to address a flaw in the agency’s deaths database in February, according to a person familiar with the matter and records obtained by The Post.
Anybody granted the appropriate permissions within Social Security could mark someone as dead, employees had realized, without having to prove their demise in any way — for example by referencing medical records or a death certificate. In emails and meetings that rose up the management chain, employees warned that the dataset was vulnerable to manipulation, according to the person and the records.
Employees’ fear was partly that a bad actor who gained access to government credentials could label groups of living individuals as dead to target them for punishment, according to the person and the records. Some of those raising the alarm worried specifically that the Trump administration might try to use the database to go after people the president dislikes, the person said. …

A staff of fewer than a dozen career employees was assigned to work with Musk’s team on the project, according to a senior official who left the agency around that time. Career employees were concerned that they might be facilitating something illegal, asking themselves if they were at risk of going to jail for the work they were doing, the official said. …

One official chose to resign rather than remain involved in what he saw as an illegal attempt to repurpose the agency for immigration enforcement. …

Within Social Security, the general counsel’s office is preparing an opinion that will find the Trump administration’s unprecedented use of the death database a violation of privacy law, according to one person with knowledge of the upcoming declaration. The opinion will take issue with the agency knowingly and falsely declaring that living people are dead, the person said. …

    2. The ability to declare someone dead and erase their legal identity is designed to make anyone, immigrant, or citizen, get disappeared.
This ability turns Trump‘s administration into an organized crime syndicate. The SAVE Act, passed by the House and is sitting in the Senate, Will disenfranchise anyone who is not a white citizen, male and assures the GOP stays in office. Welcome to the new reality!

    2. The actions of this poor excuse for an acoss and everyone associated with the dogey boys actions need to be indicted and punished for these crimes. This is the fraud, waste, and abuse. E and trump have zero proof of any dead people receiving benefits.

  5. Greg Pearre is a hero, a truly great person and I sincerely hope he returns to SSA leadership.

  6. ALL of us employed at SSA support Greg Pearre and the other whistleblowers. What is happening is illegal and immoral.

  7. Don’t look for the OGC opinion to go anywhere since SSA’s new Acting General Counsel, Mark Steffensen, is a Doge guy.

  8. The damage has already begun. Immigrants who obtained SSNs legally and are authorized to work in the U.S. went into field offices as early as last week to report that they are alive but listed as deceased in the DMF. It was verified that these individuals are not convicted criminals or “suspected terrorists”. Lives destroyed, thanks DuDick!

  11. I'm pretty conservative and have voted Republican, but this is outrageous and unacceptable.
.I just Emailed my House Rep Andy Harris, and told him I may switch my political parties over this one.
Falsifying government records with erroneous death data, is wrong and inexcusable. What's next, political enemies get phony dates of death posted to their records?

  12. Now I must log on every day to make sure I am still alive?? This is getting stupid, to say the very least. I have an immigrant sounding last name, tho my ancestors came here in the late 1800's. That being said, my last name could be one of any countries out there, it's not "nation specific". Now I gotta be scared of my last name too! Off and on throughout my family, they have legally changed their last names for one reason or another... I didn't think that something like THIS would make me consider doing the same.

  15. @10:26 a.m. Indeed. I think I see why they don't want current SSA leadership speaking to people. They keep implicating themselves and pointing out which of their higher-ups are ordering what may be illegal actions.

  16. Lee you are going to spend the rest of your life in prison when the administration ends. President . Trump will not pardon you. You are a weak person. DOGE staff will testify against you. I almost feel sorry for you, the actions you have taken have hurt America. How do you live with yourself?

  17. A senior executive at the Social Security Administration was physically dragged from his office this week after clashing with the Department of Government Efficiency (DOGE), according to The Washington Post.

Greg Pearre, a career civil servant who led an IT team working on the agency’s data systems, was removed over his opposition to a DOGE plan to cut off immigrants from key financial services, three people told the Post.

The scheme cooked up by Elon Musk’s DOGE squad falsely lists thousands of migrants as dead in a Social Security database known as the “death master file.”

  18. Section 205(r)(6) specifically prohibits the use of the DMF for this purpose:
“(6) Information furnished to the Commissioner of Social Security under this subsection may not be used for any purpose other than the purpose described in this subsection and is exempt from disclosure under section 552 of title 5, United States Code, and from the requirements of section 552a of such title.”

    1. Well, 205(r) is only about the death data that SSA gets from states - not about other death records that it creates by itself (for instance, if someone calls SSA directly to report a death). So it wouldn't apply in this case.

    2. So it’s OK for anyone to randomly make false reports that someone is dead? The difference between dead and alive isn’t a hard concept to grasp. Knowingly placing living people on the death master file authorized by this section violates the law.

  21. The banality of evil. To those who are going along to get along but worried about the illegality of their actions, rest assured, there's always the Eichmann defense.

  22. If SSA has evidence SSN records are inaccurate, why don't they update the right part of the record? SSN records already contain information about citizenship and work authorization. Fabricating dates of death is cruel, unnecessary, and stupid, while degrading the integrity of Master Death File information businesses pay to obtain.

    1. You just answered your own question. They are doing it precisely because it is cruel, unnecessary, and stupid. MAGA zealots know no other way to act. They have no fear of or respect for the law beyond laws they agree with, because they have been fully enabled by a Supreme Court that itself has no respect for law or decency.
