No Sympathy For Fraudsters Like This

      From KMTV:

Christopher Storm was 17 years old, working at Pizza Hut and going to high school in Texas when his father died. He received survivor benefits from Social Security — roughly $500 a month — until he turned 18.

After a final, lump sum payment of roughly $3,000, he says benefits stopped when he came of age. Thirty years later, the government wants that money back.

Storm and his wife, Amy, expected a tax refund this year. Instead, they were told the IRS was claiming it for a past debt. The Social Security Administration says Storm was overpaid in 1996 and now owes almost $8,000. …

This happens all the time - especially if someone starts significant work prior to graduation. If he is not at fault, he should filed a waiver, and the garnishment can be recouped.

He probably needs to file a termination grace year annual report. If he earned the money after he was done high school, he would not be overpaid and not even need to file for a waiver. File an amended annual report!! Former employee with 40 + years.

So this is a joke, right? I mean if Madoff had done this 30 years ago he would be off the hook. Ordinary statute of limitations. If non-SSA money had been given to minor child there are special rules about his capacity to understand and be liable. It does pale in comparison to the victimization of our current president, who brags about stiffing subcontractors through bankruptcy and outright STEAL. You rightfully point the finger at how problematic this is, an anomaly of federal law to disrupt lives.

Folks are overthinking this. Much like ICE using any reason to pull people in it's to boost their numbers, their stats, regardless of whether it is reasonable or not. Same here. Go after these and you've got numbers,. and can brag about being tough on crooks (oh the irony).

they may have put him into pay before giving him the retro benefits. the dad might have been disabled before dying and the aux benefits paid once the decision was issued. lots of reasons the lump sum would have seemed "final" to him even if it was to cover a period prior to when he got the ongoing benefits.
