Does It Even Matter Now?

     From SCOTUSblog:

BREAKING: The Supreme Court grants DOGE affiliates access to Social Security Administration records. Justices Kagan, Sotomayor, and Jackson would deny the request.
    The question now is whether the Trump Administration wants to give them that access. I hope not.

Why would anybody give the unstable DOGE team access to our private data? Of course it matters!

We conclude that, under the present circumstances, SSA may proceed to afford members of the SSA DOGE Team access to the agency records in question in order for those members to do their work," the Supreme Court said in its decision.

The emergency appeal to the Supreme Court was the first to land before the high court that directly involved DOGE, the initiative previously led by Elon Musk that aims to shrink the size of the federal government. DOGE's sweeping efforts have sparked numerous lawsuits. Plaintiffs have argued that the task force has violated federal privacy law governing the government's collection and use of Americans' information kept by agencies.

Jackson, joined by Sotomayor, said it's not clear that it is in the public's interest for the Social Security Administration to give DOGE staff access to Americans' data before it's been established that they are entitled to it and said the Supreme Court's decision creates "grave privacy risks for millions."

"The court grants a stay permitting the government to give unfettered data access to DOGE regardless — despite its failure to show any need or any interest in complying with existing privacy safeguards, and all before we know for sure whether federal law countenances such access," she wrote. "The court is thereby, unfortunately, suggesting that what would be an extraordinary request for everyone else is nothing more than an ordinary day on the docket for this Administration."

In a second order, the justices blocked the disclosure of DOGE operations as agency records that could be subject to the Freedom of Information Act.
The court's three liberals — Justices Ketanji Brown Jackson, Sonia Sotomayor and Elena Kagan — dissented in both cases.

Social Security Administration Commissioner Frank Bisignano welcomed Friday's ruling by the high court.

“The Supreme Court’s ruling is a major victory for American taxpayers. The Social Security Administration will continue driving forward modernization efforts, streamlining government systems, and ensuring improved service and outcomes for our beneficiaries,” Bisignano said in a statement.

In a brief and unsigned decision, the majority said access is warranted now because the courts are likely to ultimately decide that DOGE can have the information. A delay would harm the administration's reorganization efforts and not be in the public's interest, the majority wrote.

Charles, please stop buying into the idea that Elon "leaving" means anything for DOGE. DOGE isn't going anywhere, Frank is a DOGE guy as well as most of the upper level SSA management now. There's no other leadership at SSA other than DOGE. And Russell Vought was always the real brains behind DOGE and he's not going anywhere. If anything it's going to get a lot worse without Elon and the non-drug addled competent people in charge.

Giving DOGE access at SSA is about as reckless as giving a grammar school kid keys to the car to drive to school. They don’t know enough about the rules of the road to avoid crashes. It’s obvious to anyone with knowledge of how SSA works who has read DOGE’s mistaken conclusions in its findings and reports. Support for continuing to let them do that is a litmus test indicating poor judgment, or some questionable intent.
