Are the OHO attorney advisors still working with DDS? If yes, does anyone know when the attorney advisors are slated to return to the OHOs? There were zero attorney advisor decisions issued in January and February per this report.
You’re misunderstanding the chart. The chart shows that there were zero cases adjudicated as fully favorable by a Senior Attorney Advisor (without needing to involve an ALJ) during those months. That’s because they’ve been instructed to help with the writing backlog instead (which is a better use of their time anyway given the absurd constraints placed on their adjudicative ability).
The zero you see is for decisions issued by attorney adjudicators (i.e., senior attorneys), not for decisions written by an attorney advisor for an ALJ, but OHO severely restricted adjudication by senior attorneys several years back and I guess finally did away with the program. I don't know when the DDS assistance program will end, but it has nothing to do with the death of attorney adjudicator decisions.
