Is there a defined meaning to "pending?" I.e., does it mean the number of days since the request for hearing has been filed or is it, since "pending decision writing" status was applied.
I assume it is the latter, given if multiple AC remands are involved, it would not be that unlikely for a 1000+ days since the initial request for hearing was filed...then again, that makes it all the more disturbing that the extremely aged cases literally would just be awaiting their hearing.
I think it's from when the hearing request was made OR when the case got back to the hearing office after a remand. So a case where the hearing request was made on 1/1/16 counts as 365 days if it was denied on 1/1/17. Then if it goes to the AC and federal court and is remanded and gets back to the HO on 3/1/19 it's been pending 19 days as of 3/20/19.
